COMPANY POLICIES AND RELEASE OF LIABILITY
These Company Policies and Release of Liability govern the activities and services provided by ShapeShifts Coaching (SSC) LLC, including all instructors, event organizers, sponsors, and affiliates. By participating in any activities, classes, private lessons, or programs offered by SSC LLC, participants agree to adhere to the following terms and conditions.
SSC LLC, its directors, officers, instructors, volunteers, representatives, and agents, are not responsible for errors, omissions, acts, or failures of any third party conducting activities on behalf of SSC LLC. Additionally, SSC LLC is not liable for injuries or incidents resulting from participants independently practicing or replicating classes, lessons, or event activities on SSC premises or elsewhere.
Participation in SSC classes, private lessons, or programs—including but not limited to those involving nutrition, movement, or other physical activities—may test physical and mental limits and carries inherent risks, including but not limited to serious injury, disability, property damage, and even death. These risks apply not only to participants but also to volunteers, SSC employees, and owners. All participants willingly assume such risks and release SSC LLC from any related liability.
Participants must disclose any relevant health-related information that may affect their participation. While SSC LLC operates within the scope of its certifications when providing guidance, it remains the responsibility of participants to seek medical clearance before engaging in any SSC plans or programs.
Participants assume full responsibility for any risks associated with their participation, including risks arising from negligence, defective equipment, or hazardous property conditions, whether owned, maintained, or controlled by SSC LLC or its affiliates.
By signing this document, participants agree that it applies indefinitely and retroactively. SSC LLC is released from liability for any injuries, emotional distress, mental health conflicts, or other symptoms resulting from participation.
SSC LLC does not offer refunds under any circumstances. However, at SSC's discretion, program pauses or transfers may be considered on a case-by-case basis.
Copying, downloading, or sharing SSC’s protected content—including images, videos, and other proprietary materials—is strictly prohibited.
Release of Liability & Indemnification
In consideration of participation, participants, or their executors, administrators, heirs, next of kin, successors, and assigns, agree to the following:
(A) WAIVER & RELEASE: Participants waive, release, and discharge SSC LLC, its directors, officers, employees, volunteers, representatives, and agents—as well as event holders, sponsors, and volunteers—from any and all liability, including but not limited to claims for death, disability, personal injury, property damage, or property theft, whether occurring during participation or travel to and from activities.
(B) INDEMNIFICATION & HOLD HARMLESS: Participants agree to indemnify, hold harmless, and not sue SSC LLC and the aforementioned parties for any claims or liabilities arising from participation, whether caused by negligence or otherwise.
Medical Consent
Participants consent to receiving emergency medical treatment, including but not limited to CPR, AED use, first aid, or other medical interventions deemed necessary for their well-being. If participants become unconscious or unable to make decisions, SSC LLC is authorized to act in what is deemed to be in the best interest of their safety and health.
Cancellation and Reschedule Policy
A 24-hour notice is required for any cancellations or rescheduling. Due to the nature of package planning and execution, there are no refunds on packages once they have begun or on prepaid sessions. In some cases, transfers or credits may be considered. SSC LLC appreciates the understanding and commitment to participants' wellness journeys.
Should a provider need to cancel a session or package, it will not be forfeited.
